General Terms and Conditions (GTC) of the Platform foodfluencer.me


1. Scope

These General Terms and Conditions (GTC) apply to all contracts between the sole proprietorship "foodfluencer, M.Sc. Markus Pangerl, Lenaustr. 1, 81373 Munich, Germany" (hereinafter referred to as "Provider") and the registered users of the platform foodfluencer.me (hereinafter referred to as "Users"), provided that the Users are entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB). Consumers within the meaning of Section 13 BGB are excluded from using the platform.


2. Subject

Matter of the Contract (1) The Provider offers a digital platform for initiating contact between gastronomic businesses ("Gastronomes") and influencers. (2) The Provider acts solely as an intermediary and does not become a contractual party to any agreements concluded between Users.


3. Registration and Conclusion of Contract

(1) Registration with truthful information is required to use the platform.

(2) By completing the registration process and accepting these GTC, a user agreement is concluded.


4. Services of the Provider

(1) The Provider offers technical infrastructure that allows Users to create profiles, find each other, and communicate.

(2) The Provider does not guarantee successful mediation. The decision to cooperate lies solely with the Users.

(3) A review system may be provided in the future but is not guaranteed.


5. Obligations of Users

(1) Users must provide only truthful information and are prohibited from creating fake profiles.

(2) Users are solely responsible for any content they share via the platform.


6. Fees and Payment Terms

(1) Gastronomes pay a monthly fee of EUR 29.90 net.

(2) Influencers pay a monthly fee of EUR 6.90 gross.

(3) Fees are due in advance. Payment is made through the payment services integrated by the Provider.


7. Contract Term and Termination

(1) The agreement is concluded for an indefinite period and may be terminated by either party with one day’s notice before the end of the month.

(2) For annual subscriptions, ordinary termination is only possible at the end of the agreed term.


8. Liability and Indemnification

(1) The Provider is not liable for User content, the fulfillment of contracts between Users, or damages arising from such contracts.

(2) Users shall indemnify the Provider against all claims by third parties resulting from illegal or contractual use of the platform.


9. Availabilit

The Provider strives to ensure uninterrupted availability of the platform but cannot rule out downtime due to maintenance, further development, or technical issues.


10. Data Protection

The Provider processes personal data of Users in accordance with the applicable General Data Protection Regulation (GDPR). Details can be found in the privacy policy on the website.


11. Use of Third-Party Providers

The Provider uses the following third-party services:

Supabase (data hosting in the EU)

Mailchimp (communication)

Stripe (payment processing)


12. Final Provisions

(1) German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) The place of jurisdiction is the registered office of the Provider, provided the User is a merchant.

(3) If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall remain unaffected.


13. Changes to the GTC

The Provider reserves the right to change these GTC at any time with effect for the future. Users will be informed in advance by email. If the User does not object within 14 days, the amended GTC shall be deemed accepted.


14. Suspension of Users / Termination for Good Cause

The Provider may suspend or permanently delete user accounts and terminate the agreement without notice if there is a violation of these GTC, applicable law, or a justified suspicion of misuse.


15. Copyright / Usage Rights

The platform and its content are protected by copyright. Users may not use, reproduce, or distribute content that infringes on third-party rights.


16. Technical Requirements

Users are responsible for ensuring the technical requirements for using the platform, including internet access, up-to-date browser software, and email tools.


17. Electronic Communication

The User agrees that all contractual communication, notices, invoices, and information may be provided electronically, especially via email.
